Unprecedented leak to Politico indicates five justices backed a draught opinion (written by New Jersey's Justice Samuel Alito) following oral arguments last December.

Assuming the draught is genuine, it hasn't been officially published and isn't yet law.

The Supreme Court declined to comment, and NBC News did not obtain or verify the draught.

The justices' final vote and decision may also change.
